eigentumwerk is a digital tool for property managers, owners, tenants and contractors. This page explains who is responsible for what.

eigentumwerk is the platform – not a contracting party

eigentumwerk provides the technical infrastructure through which users communicate, create documents, transmit orders and document processes. eigentumwerk never becomes a party to the contracts concluded between users (management contracts, works contracts, condominium resolutions, tenancies) and assumes no liability for their content, accuracy, legality or execution.

Responsibilities in detail

Property manager: responsible for their management activity, announcements, resolutions, orders and bookings. The manager who issues a request is responsible; a second manager of the same property is jointly and severally liable.

Contractor: responsible for proper execution, qualification, safety, disposal and warranty under works-contract law (§§ 631 ff. BGB).

Owners & tenants: responsible for the accuracy of their data and reports.

Limitation of liability

eigentumwerk is liable only for the availability and function of the software within the scope of its terms (unlimited only for intent and gross negligence and under the Product Liability Act). eigentumwerk is not liable for the acts, omissions, contract contents or work results of users.
